Terms and conditions
The VEG-GAP Information Platform (VEG-GAP PLATFORM) has been developed in the VEG-GAP - LIFE18 PRE IT 003
project (December 2019-May 2022), to support activities linked to the development of a strategy to provide new
reliable information for the Urban Green Air Quality Plans, taking into consideration the peculiar characteristics
of the Urban vegetation ecosystems. The project has been endorsed by the following partners: Agenzia nazionale
per le nuove tecnologie, l'energia e lo sviluppo economico sostenibile (ENEA) as coordinator, Consiglio per la
ricerca in agricoltura e l'analisi dell'economia agraria (CREA), Universidad Politécnica de Madrid (UPM), ARIANET
S.r.l (ARIANET), Meteorological and Environmental Earth Observation (MEEO), Comune di Milano (CDM), Città
Metropolitana di Bologna (MCBO), Ayuntamiento de Madrid (MAD).
The ownership of the VEG-GAP Information Platform is of MEEO; the ownership of the Content integrated is
property of the project partner that owns and has provided the Content.
The VEG-GAP Information Platform management entity is MEEO, who is in charge to integrate the VEG-GAP
estimates data produced by the scientific partners (ENEA, UPM, ARIANET, CREA) using the numerical models AMS,
and to curate the full data management life cycle.
The VEG-GAP Information Platform is hosted at ENEAGRID/CRESCO (Computational RESsearch Centre on COmplex
systems) the integrated infrastructure for high performance computing managed by ENEA.The entire group of the
following articles constitutes the present Terms and Conditions document.
Article (1) VEG-GAP Information Platform
Registered users have access to the VEG-GAP Information Platform through which they can discover, access,
combine and visualize the VEG-GAP estimates data, derived products and description, herein referred as the
Content. VEG-GAP estimates data download is allowed under specific policies (see Article 2).
Article (2) Data access policies
VEG-GAP estimates data accessible through the VEG-GAP Information Platform may only be used under the terms
of the license attributed to it, as updated from time to time by the data owners.
Article (3) No Endorsement

No user may publicly represent or imply that the VEG-GAP Information Platform management entity is
participating in, or has sponsored, approved, or endorsed the manner or purpose of the use or reproduction of
any of the Content.
Article (4) Discontinuation and Termination
The manager ensures that the VEG-GAP Information Platform has been configured and, whenever possible, will
be managed by using the most appropriate approach and tool to guarantee the proper and continuous operation.
Nevertheless, the manager cannot exclude that, sometimes, some failure, omissions or transmission problems
could occur, and he declines every direct responsibility on possible related delays, inaccuracies, or errors.
The VEG-GAP Information Platform management entity reserves the right, at any time, to modify or discontinue,
temporarily or permanently, the Content as well as any means of accessing or utilizing it at its sole discretion with
or without prior notice to users.
The VEG-GAP Information Platform management entity may at its sole discretion, under any circumstances, for
any or no reason and with or without prior notice to users, terminate any user’s access to the Content, particularly
in cases of violation of these terms of use or any of the applicable license terms.
Article (5) Access, use of the content and responsibility
MEEO authorizes the end users (following called “users”) to freely access, download and use the platform data
only for non-commercial use of the data in accordance with the Terms and Conditions articles here described. The
content of the VEG-GAP PLATFORM cannot be assigned to third parties.
The information provided on VEG-GAP Information Platform is published on the site as an information activity.
Therefore, it is not guaranteed that the contents on the site may be suitable for any purpose and / or particular
use of the users and the manager is not liable for any damages, of any kind, deriving from the use of the
information contained on the site by users. The information contained on the site must always be used as general
criteria that may not be valid in the specific case, which the user is required to evaluate independently, assuming
sole responsibility for his active and omissive conduct.
The information contained on the site constitutes a product of a high scientific level, the result of the best
techniques currently available on air quality modelling. The purpose of the producers of the data is to keep the
information up to date and accurate; any errors found will be resolved as quickly as possible.
The manager disclaims any liability arising from unauthorized, improper or incorrect use of the data, materials
and information contained on this site. They constitute an uninterpreted product, therefore their use must be
aware, prudent, conducted by adequately trained technical personnel and under the exclusive responsibility of
the end user, who may have access to the data according to these terms of use.

The manager cannot be held responsible for the harmful or dangerous consequences that arise directly or
indirectly from accessing the site.
By accessing the site, the user undertakes to:
a. Not to claim the information contained therein as one's own;
b. Acknowledge and accept that the VEG-GAP Information Platform or parts of it may be temporarily
inaccessible due to malfunctions and / or connection defects or in any case events beyond the control of
the operator;
c. Not to use the VEG-GAP Information Platform or the material included in it to pursue illegal purposes or
as a tool to disclose or disseminate in any way material or content intended for the commission of illegal
activities;
d. Not to use the VEG-GAP Information Platform in such a way as to interrupt, damage or make part or all of
it less efficient or in order to damage in any way the effectiveness or functionality of the VEG-GAP
Information Platform;
e. Not to use the VEG-GAP Information Platform for the transmission or placement of viruses or any other
material that is defamatory, offensive, obscene or threatening or that in any way may cause annoyance,
disturbance or any prejudice;
f. Not to use the VEG-GAP Information Platform in a way that constitutes a violation of persons or companies
(including, but not limited to, copyright or confidentiality rights);
g. Not to use the VEG-GAP Information Platform to transmit material for advertising and / or promotional
purposes without the written permission of the manager.
The manager reserves the right to request that hypertext links to this VEG-GAP PLATFORM be removed at any
time.
Article (6) Intellectual Property
The owners hold all rights in relation to all information provided on the site or through it (including text, maps and
graphics). The use of the site is for governance or scientific purpose or purely personal but non-commercial. It is
therefore forbidden to copy, modify, upload, download, transmit, publish, or distribute the content or trademarks
of the site to third parties for commercial purposes. The user, for purely personal purposes and never of a
commercial nature, has the right to download data, texts or other contents of the site and to disseminate them
provided that these terms of use are respected, and provided that the source of the data is explicitly and clearly
indicated as following:

The data manager, the data owners and the European Commission are not responsible for any use that may be
made of the information available on VEG-GAP platform
The logos, trademarks and other content owned by third parties belong to their respective owners and cannot
be reproduced without their consent.

Article (7) Exclusion of Liability and Warranties
Other than in cases of intentional or grossly negligent breaches of duty by its staff or representatives or claims
resting on an injury to life, body or health, the VEG-GAP Information Platform management entity shall not be
responsible nor liable to any user of the platform for any loss or damage of any sort incurred in connection with
the use of the platform.
The VEG-GAP Information Platform management entity shall not be responsible or liable for the accuracy,
usefulness or availability of any Content.
The data owners does not warrant that data from VEG-GAP Information Platform will be free from errors or
omissions or that such errors or omissions can or will be rectified, or that there will be an uninterrupted access to
data. Any Content made available for download or use through or within VEG-GAP Information Platform is
supplied "as is" without further warranties of any kind, either express or implied, including, but not limited to, the
quality, performance, merchantability or fitness for a particular use or purpose. Subject to the aforesaid, the VEG-
GAP INFORMATION PLATFORM management entity shall not be liable for any damages, including but not limited
to direct, indirect, special, incidental, punitive, exemplary, or consequential damages arising out of the use of or
the inability to use the Content.
The VEG-GAP Information Platform management entity shall not be liable and accepts no representation or
responsibility for the functionality or contents of external websites, services or software products hyperlinked
from VEG-GAP Information Platform.
The VEG-GAP Information Platform management entity disclaims all warranties related to the provision of Content
through VEG-GAP Information Platform.
Article (8) Protection of Personal Data
The VEG-GAP Information Platform management entity Data Protection and Privacy Statement applies to all
personal data provided by the user in order to register. For more details please refer to the Data Protection Privacy
notice.
Article (9) Severability
If any provision of these Terms of Use is for any reason held to be invalid, illegal or otherwise unenforceable, such
unenforceability does not affect any other provision; the Terms of Use are then to be construed as if they had
never contained the provision(s) in question and are to be interpreted, in so far as possible, in such a way as to
maintain their original intent.

This site and these rules and conditions are regulated and built in accordance with Italian law, being the law of
the country where the VEG-GAP Information Platform is located.
In the event of discrepancies or differences in interpretation between any different versions of these rules and
conditions, the Italian version must prevail.
The Italian law shall be applied to all legal relations arising in connections with this Terms and Conditions. In case
of litigation the court of competent jurisdiction is the Civil Court of Bologna. Legal proceedings shall be in Italian.
Article (11) Right to Modification
The VEG-GAP Information Platform management entity reserves the right to modify these Terms and Conditions
at any time. Any revised terms will be posted on the VEG-GAP Information Platform website. Modifications shall
take effect immediately following posting of the revised Terms and Conditions.
